Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and NovaPod ("NovaPod", "we", "us") covering your use of the NovaPod mobile app, the website at novapod.app and app.novapod.app, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use NovaPod

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms. You must provide accurate account information and keep it up to date. You are responsible for everything that happens under your account and for keeping your login credentials secure.

2. Your content

"Your Content" means anything you post, upload, or share through the Service — projects, posts, images, text, comments, messages, and profile information. You keep all ownership rights in Your Content.

By posting Your Content, you grant NovaPod a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example to resize or transcode), publish, and display Your Content solely to operate, provide, and promote the Service. This licence ends when you delete Your Content or your account, except that (a) we may retain copies for a reasonable period in backups and (b) content you shared with other users may remain visible to them.

You are solely responsible for Your Content. You represent that you own it or have the rights to post it, and that it does not infringe anyone's intellectual property, privacy, or other rights.

3. Community rules — zero tolerance for objectionable content

You agree not to post, share, or transmit content, or engage in conduct, that:

harasses, bullies, threatens, defames, or intimidates any person;
promotes hatred or violence against people based on race, ethnicity, national origin, religion, disability, disease, age, sex, gender identity, or sexual orientation;
is sexually explicit, contains nudity, or sexualises minors in any way;
depicts or encourages self-harm, suicide, or dangerous acts;
is illegal, facilitates illegal activity, or violates the rights of others (including copyright, trademark, and privacy rights);
is spam, a scam, fraudulent, or deliberately misleading;
impersonates another person or misrepresents your affiliation;
contains malware, or attempts to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service.

Reporting and moderation. Every post, comment, project, and profile can be reported from inside the app, and you can block any user at any time. We review reports and act on objectionable content and abusive users within 24 hours — by removing content, issuing warnings, or suspending or terminating accounts. There is zero tolerance for objectionable content or abusive behaviour on NovaPod.

4. NovaPod Pro and purchases

NovaPod offers an optional subscription, "NovaPod Pro", and may offer other paid items such as sticker packs. Purchases are processed by Apple through your App Store account, and Apple's terms and refund policies apply.

NovaPod Pro is an auto-renewable subscription. Payment is charged to your App Store account at confirmation of purchase.
The subscription renews automatically for the same period at the same price unless you cancel at least 24 hours before the end of the current period.
You manage or cancel your subscription in your device's Settings › Apple Account › Subscriptions. Deleting the app does not cancel a subscription.
Except where required by law or by Apple's policies, payments are non-refundable and partial periods are not refunded.
Prices and features may change; we will give reasonable notice of material changes, and changes will not affect a period you have already paid for.

5. Acceptable use of the Service

You agree not to:

use the Service for anything unlawful or in breach of these Terms;
collect or scrape data about other users without their consent;
interfere with, probe, or disrupt the Service or its infrastructure;
use bots or automated means to create accounts, posts, or engagement;
resell or commercially exploit the Service without our written permission.

6. Suspension and termination

You may stop using the Service and delete your account at any time from Settings › Account in the app. We may suspend or terminate your access, remove content, or limit features if you breach these Terms or the community rules, if required by law, or to protect the Service or its users. Where practical and appropriate, we will give you notice.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, secure, or error-free. You use the Service at your own risk. NovaPod is not responsible for the content, conduct, or reliability of other users.

8. Limitation of liability

To the maximum extent permitted by law, NovaPod and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 50. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Indemnity

You agree to indemnify and hold NovaPod harmless from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which the operator of NovaPod is established, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts of that place, except where mandatory local consumer-protection law gives you the right to bring proceedings in your country of residence.
